| 1. CONTENT STANDARDS - You must be the creator or lawful owner of any Content you upload. This generally means that the Content depicts you (the Author). If other persons are depicted, they must be adults who have given you permission to be depicted in the Content and to upload it to the Platform. - Content must not fall into any of the prohibited categories listed below. Even if something may be lawful under certain circumstances, if it is included in the list of prohibited items in this section or in other Platform documents (for example, extreme violence or zoophilia, which are unlawful), such content is always prohibited from being published on the Platform. Prohibited content includes: - Pornographic content — material (video recordings, audio recordings, photographs) in which genitalia or sexual acts are displayed in an explicit manner, without artistic or scientific value, for the purpose of arousing sexual interest. - Child sexual abuse material — any content in which minors (persons under the age of 18) are depicted or involved in a sexual, erotic, or pornographic context is absolutely prohibited. This includes real minors, animated or computer-generated images depicting minors. Even non-explicit images of minors are prohibited (e.g. a clothed child in a sexual situation). The presence of a minor in the background of an adult scene (e.g. a video in which an unrelated child is briefly visible) is also prohibited. Authors must take care to ensure that minors are not visible or included in their content. - Zoophilia — any sexually oriented content involving animals is prohibited. This includes real sexual acts with animals, as well as pornography in which animals are depicted in a sexual context. - Rape / non-consent or incapacitation scenarios — content depicting rape, sexual assault, or any sexual activity in which one of the parties does not or cannot consent (e.g. is unconscious, drugged, or otherwise helpless) is prohibited. This applies even where such content is presented as a "fantasy" or role-play scenario. - Sexual violence and extreme cruelty — depictions of sexual violence, torture, or degradation that go beyond the boundaries of consensual BDSM are prohibited. For example, realistic depictions of executions, real physical injury (bleeding, extreme pain) in a sexual context, and similar content are prohibited. - Incest — sexual content depicting sexual relations between close relatives (incest) is prohibited, even where the parties are consenting adults, on grounds of social and legal norms. - Necrophilia — any sexual content involving or purporting to involve corpses or deceased persons is strictly prohibited. - Human trafficking / exploitation — any content that even alludes to human trafficking, sexual exploitation, or prostitution is prohibited. Do not create content that appears to be advertising sexual services for money, or that depicts persons being coerced or exploited (e.g. a video with a title or appearance suggesting that someone is being forced to perform acts for money). - Unlawful drug use — content depicting the use of unlawful drugs in a sexual context (or generally promoting drug use) is prohibited. - Misleading or non-integrated content — you may not upload content that is essentially "bait" — for example, publishing a thumbnail showing one thing while the actual content is unrelated (particularly where the actual content violates the Rules or disappoints Supporters). You may also not publish empty or meaningless content as Premium content; something of value must be provided in exchange for credits. - Private or confidential content — you may not share content containing the personal data of other persons (e.g. explicit photographs of another person published without their consent ("revenge pornography"), or documents revealing another person's identity, telephone number, etc.). You may not leak or publish private communications (text messages, emails), particularly where a third party participated in them without consenting to their publication. - Intellectual property infringement — do not upload content that you do not own or do not have the rights to. This means you may not upload professional pornographic videos or photographs from other websites, television programmes or films, music to which you do not hold the rights, or images taken from the internet. The Platform is not a file-sharing service for pirated content. If your Premium content includes fragments of third-party material (for example, music playing in the background of a video), you must ensure that this does not infringe copyright or that you hold an appropriate licence. If we receive copyright infringement notices in relation to content you have published, we will remove the content and may issue you with a warning or terminate your content creator privileges in the case of a serious infringement. - Other unlawful content — any content that positively or instructively promotes or depicts unlawful activity is prohibited. - Prostitution, escort services, or any other sexual services for reward — do not upload any content depicting sexual services for reward, and do not advertise such services. Any offer to meet, perform acts in real life, or pay for sexual acts will be treated as a serious violation. It is equally prohibited to seek such services, to offer other Users reward for such services in real life, and similar conduct. - The list of prohibited content set out above is not exhaustive. Platform administrators may, at their discretion, remove content that, although not explicitly listed above, is considered contrary to law or the spirit of the community. - In addition to prohibited content, we also strictly prohibit certain conduct in connection with use of the Platform: - Do not use the Premium content function (or any communication tools through the Platform) to harass, threaten, or stalk other Users. Hate speech (attacking or insulting a person on grounds of race, religion, gender, sexual orientation, etc.) is prohibited. If you harass or direct hate speech at another User, your account may be closed. - Do not use the Platform to send spam messages or advertising. As a User, do not send other Users unsolicited messages relating to advertising or similar content. In addition, you may not advertise third-party products or services in your content or in messages associated with it (for example, using the Platform to promote unrelated businesses or other websites). - You may not impersonate Platform employees or other persons. - You may not attempt to hack, use DDoS attacks, cheat, or otherwise compromise the security or functionality of the Platform. This includes attempts to copy content using automated bots, install malicious software, or exploit any bugs. If you discover a security vulnerability, please report it to us rather than exploiting it. - It is prohibited to use automated accounts or programmes (bots) to simulate views or likes in order to boost an Author's ranking in the Platform's algorithms. - If you observe Content that clearly violates section 1.2 (for example, child exploitation or other serious violations), or if someone is encouraging you to participate in unlawful activity through the Platform, you must report it immediately through the designated channels (for example, by pressing the "Report" button). Upon receiving a report, we will carry out an investigation without delay. If the content is found to violate the Rules or applicable law, we will remove it or block access to it. In the case of obvious violations — particularly serious ones, for example involving minors or criminal activity — the content will be removed promptly and permanently. - If your Content is removed or your account is affected due to a violation, the Platform will provide you with a clear and specific explanation (except where the Content constitutes deceptive large-scale commercial spam), including: information about the decision taken (including information about any reports received on which the decision was based); information about the automated tools used; a reference to the legal basis or the basis in the Rules; and an explanation of why the content is considered unlawful or incompatible with the Rules. You will generally have the opportunity to submit an appeal or provide an explanation if you believe an error has been made. Appeals may be submitted to our support email address or through a form where one is provided. We will review the case again, but our decision following the appeal is final. - Enforcement actions may include: - Removal of specific content. - Warnings or temporary suspension of your account. - Permanent closure (ban) of the account for serious or repeated violations. - Referral to law enforcement authorities where the content is unlawful (we will comply with police requests or legal processes and will, for example, report any child sexual exploitation material together with any available user data). - When we remove Content from public view, it may remain in our secure database or backups for a period of time. We may also retain evidence of violations (for example, copies of unlawful content and User data) where this is required for cooperation with law enforcement authorities or for legal defence purposes. 2. USER-GENERATED CONTENT - The Platform allows you and other Users to create, publish, and share Content. You retain all ownership rights to the Content you create and share on the Platform. For example, when you publish a photograph, you remain the copyright owner of that material. The Platform does not claim ownership of your original content. However, by publishing Content on the Platform, you grant us certain rights in that content so that we may display and distribute it on the Platform. - By submitting or publishing content on the Platform, you grant us the right to use, reproduce, host, store, copy, modify (for technical purposes, such as resizing or compressing images or videos), distribute, transmit, publicly display or perform, and create derivative works of your Content solely for the purposes of operating, developing, providing, and promoting the Platform and our services. This means, for example, that we may display your content to other Users, we may re-encode or resize uploaded videos or images so that they are displayed correctly on various devices, or we may create thumbnails or excerpts of your content for use in website features or Platform promotional materials. - Content you have published will not be accessible to other Users following its deletion or account termination, but may be retained in backups for a limited period. If your Content was shared with other Users (for example, Premium content accessed using credits), those Users may retain a limited copy of the Content in their message history or device cache. In addition, we may retain certain Content where this is necessary for the performance of legal obligations or to substantiate our actions (for example, collecting evidence of the publication of unlawful Content). - By publishing Content, you confirm and warrant that: - You hold all necessary rights to publish the Content. This means that the Content is your original work or that you have obtained all necessary permissions and rights from third parties who own any part of the Content. For example, you do not upload videos, photographs, or texts created by another person unless you have their permission. - If other persons appear in your Content (for example, someone in a photograph or video you are sharing), you must first obtain their explicit consent to include them and to publish the content on the Platform. You agree to provide us with evidence of such permissions or age confirmations upon request. - Your Content does not infringe the intellectual property rights of any person (copyright, trademarks, etc.). For example, you will not include music, videos, images, or text created by another person unless you have permission to do so. You will not use another person's trademarks or logos. - The Content you submit does not violate the privacy, confidentiality, or personal data protection rights of other persons and does not include other personal information without explicit consent. - Your Content does not contain defamatory, libellous, or offensive material directed at any person, nor does it contain hate speech or harassment. - The Content you create and publish complies with applicable law. 3. Content Policy (Zero Tolerance) The Service Provider does not tolerate the following violations (zero tolerance policy) and closes the account without separate notification: 1. Minors, children; 2. Illegal drugs; 3. Violence, blood, torture, pain, erotic asphyxiation; 4. Organization of sexual services; 5. Human trafficking and sexual exploitation; 6. Necrophilia; 7. Discussion, promotion, or organization of pedophilic activity; 8. organizing employment or recruitment arrangements with Platform users; 9. Bestiality or animals in a sexual context; 10. Content containing scenes of sexual violence; 11. Using another person's account; identity theft; 12. Violation of third-party intellectual property; 13. Fraud or financial harm to the Service Provider. 14. Actions that cause financial damage and/or damage to the reputation of the Service Provider and/or the platform; 15. Disrespectful or abusive behavior towards the platform and/or the platform administration and/or its employees on the platform and/or a third party. 4. Prohibited Content You may not upload, store, transmit, or distribute content that is offensive, defamatory, obscene, threatening, illegal, or encourages illegal activity, including: 1. malware or security-compromising tools; 2. solicitations or advertisements; 3. promotion of illegal activities; 4. job or promotional offers; 5. personal data (phone numbers, addresses, ID numbers, etc.); 6. spam or duplicate content; 7. promotion of other platforms; 8. requests for bank transfers; 9. escort services; 10. any direct or indirect payments between users, including via messages or credits. The Platform does not allow the sale, purchase, or monetization of user-generated adult content. Violations may result in immediate account termination and reporting to authorities. 5. Content Usage Restrictions This platform is the property of ClubX.lv. No content may be reproduced, republished, uploaded, transmitted, or distributed. All trademarks and brand elements belong to ClubX.lv. The Platform may restrict or remove content at its sole discretion to ensure compliance with payment network rules. 6. Content Ownership You confirm that you own or have full rights to the content you upload. All uploaded content becomes part of the ClubX.lv database (license granted). No royalties are paid. 7. Content Monitoring and Compliance To ensure safety, legality, and compliance with payment partner requirements, the platform applies advanced moderation and risk control measures. 7.1 Pre- and Post-Moderation All content is reviewed before publication and continuously monitored afterward. The platform may remove content or block users at any time. 7.2 AI and Automated Systems The platform uses AI to: 1. detect minors 2. identify illegal or harmful content 3. detect fraud and fake accounts 4. analyze behavior 5. detect AI-generated media 7.3 Mandatory Approval 1. All uploaded images and videos must be approved before publication. 2. Unapproved content is not visible to other users. 3. The platform may reject any content that does not meet legal or internal requirements. 7.4 Reporting System 1. The platform has an integrated reporting system. Any user can report content or behavior related to: illegal content, possible minors, fraud or impersonation, violations of the rules. 2. All users can report violations on the platform, including but not limited to reports of fake photos, fake members, and crimes in progress. Such reports are prioritized and processed on an urgent basis. Response times: - Critical violations (e.g. minors): up to 24 hours - Other reports: up to 72 hours - Obviously illegal content will be removed immediately. 7.5 Audit Logs The platform stores information about content uploads, changes, removals and moderation decisions. Data is stored in accordance with legal and partner requirements. Audit logs are stored for the entire lifetime of the user and for 24 months after the profile is deleted. 7.6 Cooperation - The platform cooperates with payment networks (Visa Inc., Mastercard), payment service providers, banks and law enforcement agencies. In case of violations, information may be transferred to the responsible authorities. 8. Content Provider Agreements - All users electronically accept the Content Provider Agreement (CPA) before gaining access to upload photos and videos. The CPA is a separate agreement, independent of the general terms of service of the platform. Content creators’ obligations under the CPA: 1. Comply with all platform rules and applicable laws. 2. Confirm that all content is voluntary, lawful, and created by the user. Only consensual content is permitted. Any content that may contain elements of violence or non-consensual activity is strictly prohibited and will be removed immediately. 3. age and consent of all persons in the content and, if necessary, provide it to the platform or competent authorities. 4. Guarantee that all persons depicted in the uploaded content are of legal age (18 years or older). 5. Confirm that they own all intellectual property rights to the uploaded content. 6. Comply with Visa and Mastercard’s Acceptable Use Policy for Adult Content. 7. Agree to cooperate with any compliance audit or investigation. 8. Acknowledge that violations may result in immediate account termination. |
